Damage

When you receive your package, check it carefully.  It is very important that you note any possible damage to the delivery driver.  If you accept a damaged shipment without noting it with the carrier, we may not be able to file your claim for damages.  Please call us as soon as possible, if you see that your product is damaged.

Returns

Within 30 days of receipt of your shipment, you may return any unopened item with original packaging and accessories.  There will be a 20% fee applied to all returns and cancellations.  All shipping charges are your responsibility. By cancelling or returning an item, you must pay to have it shipped to our warehouse, plus you must reimburse us for any shipping costs incurred in the original shipment.  Our goal is to make certain that you order the equipment you want.

Lotions, Bulbs and other Accessories – You may return any of these items within 7 days in new, unopened, unused condition for a refund, less shipping charges and less a 20%  fee.  Because of these shipping and restocking/cancellation fees, it is imperative to make sure you buy the product you want the first time!

Parts or any special order items like, acrylics, shocks, electronics are non-refundable.  If you were shipped the wrong part please contact your part representative.

Shipping

Our items that ship motor freight are only tailgate delivery.  This means the Freight Carrier is only responsible for getting the freight off the truck (in most cases they require the customer to help).  The freight carrier is not responsible for bringing freight inside or doing any assembly.  If you are in a rural area or an area that is not accessible by semi-trucks you may have to make arrangements with Freight Carrier to have the freight delivered at another location.  We are not responsible for any charges that the freight carrier may offer you as extra services (Inside Delivery or Lift-Gate Service just to name a couple).

Expedited service may be available, for an additional charge. We are not responsible if an item is not delivered by a requested time.

In the event that a backorder may occur, we will fill your partial order, then we will send you the remaining items as soon as possible, and at no additional shipping charge to you.

Cancellations

All cancellations are subject to a 20% fee of the purchase price plus any shipping costs incurred, your account representative can tell you more.

Ordering Terms and Conditions

Your use (accessing, browsing, buying, etc.) of our websites is your legal agreement to the policies, terms and conditions below. You also agree to comply with all applicable laws and regulations, including exports and re-exports control regulations. If you do not agree to these terms, do not use this site. 

Limitation of Liability IN NO EVENT SHALL THE STORE OWNERS, ITS PARENT, SUBSIDIARIES, OR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, USE, OR PROFITS), HOWEVER CAUSED, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, AND WHETHER OR NOT THIS COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU AGREE THAT THE COMPANY PARTIES MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTIONS LAW IS APPLICABLE TO THIS AGREEMENT.

Governing Law

Notwithstanding principles of conflicts of law of any jurisdiction to the contrary, all terms and provisions of this Agreement are to be construed and governed by the laws of the state of North Carolina without regard to the laws of any other jurisdiction. The Purchaser waives any and all privileges and rights which they may have under North Carolina Statutes , relating to venue as it now exists or may hereafter be amended, and under any other statute, or administrative provision thereof in any legal action on this Agreement; and further, the Purchaser agrees that any legal action brought on this Agreement or in connection therewith, shall be brought in the appropriate court in Craven County, North Carolina.
